BikeMaar Terms and Conditions

1. Definitions

This agreement sets the conditions for renting electric bikes and city bikes from the company BikeMaar (hereinafter referred to as the “Rental Company”) by the customer (hereinafter referred to as the “User”).

2. Pricing

The rental fees are defined according to the price list in effect at the time of booking, available on our website and at pick-up points.

3. Payment

1. Payment Method: Payments must be made via credit or debit card.
2. A €50 hold is applied to the credit card for city bikes and €100 hold is applied to the credit card for electric bikes.
3. Identification Document: A valid photo ID must be presented for any rental.
4. Cash Payments: Accepted only at authorized locations and subject to availability.
5. Deposit Coverage: The deposit covers damages or outstanding amounts if the bike is not returned as agreed.
6. Cancellations: Cancellations made at least 48 hours in advance are eligible for a full refund or credit for a new date. Requests must be made by email.

4. Rental Duration

1. The rental period begins at the time specified in the reservation.
2. The bike must be returned by the agreed end time.
3. Time extensions must be authorized in advance and will incur additional charges.
4. Early returns do not qualify for partial refunds.
5. Late returns or failure to return the bike will be charged according to the current price list and may result in legal action and additional fees.

5. Use of the Bicycle

1. Bikes are for individual, responsible use only, within permitted areas.
2. Bikes must be returned clean, undamaged, and with all accessories provided.
3. Use in areas such as beaches or dunes is prohibited, except on paved bike paths.
4. The User is responsible for taking care of the bike and preventing theft or damage.

6. Damage, Loss, and Theft

1. In case of theft or damage, the User is responsible for costs as detailed below:
   • Electric bike not returned + no keys: up to €1430
   • Electric bike not returned + with keys: €330 (deductible)
   • Returned without keys: €100
2. Components such as battery (€700), charger (€250), and display (€150) are not covered by the protection plan and must be reimbursed.
3. Additional items (helmet, lock, child seat) must also be returned or paid for separately.
4. In case of non-payment, charges will be handed over to a collection agency. The minimum collection fee is €750 per bike.

7. User Responsibilities

The User is responsible for any operational costs during use, such as parking, maintenance, or occasional repairs caused by misuse.

8. Personal Data

Your data will be used solely to facilitate the rental and improve our services, in accordance with Dutch privacy laws (AVG). You may request deletion or restriction of your data at any time.

9. Limitation of Liability

BikeMaar is not liable for accidents or damages resulting from improper or careless use of the bike. We are also not responsible for hidden defects that interrupt usage, except in cases of proven negligence by the company.

11. Applicable Law

This agreement is governed by the laws of the Netherlands. Any disputes shall be settled under the jurisdiction of local courts.
